The company

What is personal data?

Personal data is any information relating to an identified or identifiable natural person. Personal data includes e.g. name, e-mail address or telephone number. Personal data also includes information about websites visited. Our policy is to collect, use and/or disclose personal data only if this is permitted by law or if you consent to the data processing.

How is your data collected and used?

Visit our website

When you visit our website, we automatically collect information in "server log files" that your browser transfers to us. For that purpose, our website uses cookies. Cookies are small text files stored on your hard drive assigned to the browser you use. Our website uses the following types of cookies:

  • Transient cookies: These are automatically deleted when you close the browser. Transient cookies store your session ID, with which different requests from your browser can be assigned to the shared session. This will enable your computer to be recognized when you return to our website. Session cookies are deleted when you log out or a certain amount of time has passed.

  • Persistent cookies: These are only deleted after a certain period, which may vary depending on the cookie. You can delete cookies at any time in the security settings of your browser. Please note that you may not be able to use all features of this page when you delete cookies from your browsing history. The setting of cookies can be prevented at any time by appropriate settings in the user's internet browser.

We collect the following data:

  • Type/version of the browser

  • System software used

  • Referral URL

  • Device hostname

  • The time of the server request

  • Country code

  • Language

  • Name and version of the operating system

We only use this data for statistical analysis for the purpose of operation, security and optimization of our website. However, we reserve the right to check this data afterwards if there is a justified suspicion of illegal use based on specific indications. This data is then stored because this is the only way to prevent abuse of our website and, if necessary, to allow us to investigate any crime committed. The storage of this data is necessary to protect us as the entity responsible for the processing of the data. In principle, this data will not be passed on to third parties, unless there is a legal obligation to pass it on, or the transfer of data serves criminal purposes.

This data processing is based on Art. 6 (1) f. GDPR (European Union General Data Protection Regulation, regulation (EU) 2016/679), as we want to stabilize and improve our website and establish quality assurance and fraud prevention.

If you contact us (e.g. via e-mail), your information will be stored for the purpose of processing the inquiry and in the event that follow-up questions arise. This takes place on the basis of your consent (Art. 6 (1) a. GDPR) or for the purpose of processing your inquiry (Art. 6 (1) b. GDPR).

Newsletter

On our website, you can sign up for our newsletter, which allows us to inform you about product updates and news.

When signing up for the newsletter, you must provide an e-mail address. After registration, you will receive an email to confirm the registration ("double registration"). By clicking on the registration link, you have given your consent to the processing of your personal data in order to receive our newsletter in accordance with Art. 6 (1) a. GDPR and we may process such data accordingly. When registering for the newsletter, we also save the date of registration.

Mailchimp

Mailchimp is a service of Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA, with which the sending of newsletters can be organized and analyzed. With the help of Mailchimp, we can analyze our newsletter campaigns. When you open an email sent with Mailchimp, a file in the email ("web beacon") connects to the Mailchimp servers in the United States. This allows you to determine whether a newsletter message has been opened and which links have been clicked. In addition, technical information is recorded (eg time of registration, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. They are used exclusively for statistical analysis of newsletter campaigns. The results of these analyzes can be used to better adapt future newsletters to the interests of the recipients.

The mail provider "Mailchimp" receives and processes on our behalf the data necessary for the order, in particular e-mail address, IP address, device name. This data is processed on servers in the United States. Mailchimp is certified under the "Privacy Shield". "Privacy Shield" is an agreement between the European Union (EU) and the United States to ensure compliance with European data protection standards in the United States.

If you do not want Mailchimp to analyze your data, you must unsubscribe from the newsletter. For this purpose, we provide an unsubscribe link in each newsletter. Details of Mailchimp and its privacy policy can be found at the following link: https://mailchimp.com/legal/privacy/

The data saved for the purpose of newsletter registration will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from Mailchimp's servers after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g. email address for the use of the services) remains unaffected.

Recording and storage of data

We collect biodata, i.e. information about the body's movements, muscle activity and forces. We only store data locally on our computer. We make sure to anonymize the data we store so that biodata cannot be linked back to the person it belongs to. Our biodata consists of a series of numbers, and does not reproduce sensitive information such as names, pictures or anything else that can lead back to the person whose data we are evaluating.

You can inform us at any time that we must remove the data stored locally on our computer. If that is the case, contact: frederik@motioncatch.dk.

Who has access to your data?

You, apart from us, are the only one who has access to the data we collect.

Duration of storage of personal data; deletion periods

We generally only store your personal data as long as it is necessary for the performance of the contract or the respective purpose and limit the storage period to an absolutely necessary minimum. Therefore, we delete your personal data if your use of the Services ends and you have not agreed to further use. An extended storage will only take place if there is a legal obligation or if you have consented to it.

Is your data transferred to third parties?

We will only transfer your personal data to a third party within the framework of legal regulations, i.e. in the course of a data processing agreement, or if we are required to transfer the data due to a government or court order, or, if applicable, legal provisions permit the transfer, or if you give your express consent.

Google Analytics

We use Google Analytics, a web analysis tool offered by Google Ireland Limited Gordon House, Barrow Street Dublin 4, Ireland. This analysis service uses cookies. Cookies are generally transferred and stored on Google's server in the United States. Since IP anonymization is active on this website, your IP address will be shortened by Google within EU member states. This information will be used to evaluate your use of the services offered here and enable us to analyze your website activity and provide other services associated with the service. The IP address transmitted from your browser as part of Google Analytics will not be combined with other data from Google.

Adjusting the settings of your browser software can prevent the use of cookies. In this case, it may be possible that the functions of the services offered here cannot be used in their entirety. Is your data transferred outside the EU?

We do not transfer your personal data to any third-party provider or location outside the European Economic Area except in accordance with the safeguards required under the GDPR.

What are your rights?

As registered, you have the right to:

  • to withdraw your consent to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future;

  • to object to the processing of your personal data if your personal data is processed on the basis of legitimate interests in accordance with Art. 6 (1) f. GDPR to the extent that there are reasons for this arising from your particular situation;

  • to obtain rectification from us without undue delay of inaccurate personal data about you;

  • to obtain the deletion of your personal data stored with us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to claim, exercise or defend legal claims;

  • to demand restriction of the processing of your personal data if the accuracy of the data is contested by you, the processing is unlawful but you refuse deletion and we no longer need the data but you need it to assert, exercise or defend legal claims, or you have objected to the processing;

  • to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request transfer to another data controller.

If you have given your consent to the processing of your data, you can revoke it at any time by sending us an e-mail at frederik@motioncatch.dk. Such revocation will affect the admissibility of processing your personal data by us. To the extent that we base the processing of your personal data on interest weighting, you can object to the processing. This is the case if the processing of your data is not necessary to fulfill a contract with you.

In the event of your justified objection, we will investigate the situation and either stop the processing of your data, adapt the data processing or point out our compelling legitimate reasons for continuing the processing.

In general, we only process personal data if necessary. As soon as the purpose of the data processing is fulfilled, the data is deleted.

What security measures are in place to protect your data?

We have installed technical and organizational measures to secure our website and/or products against loss, destruction, access, modification or distribution of your data by unauthorized parties.

Obligations for our customers who control other people's data

Motioncatch is committed to complying with all data protection requirements in any location where the Services are used. You should exercise caution when handling personal data about individual carriers and other data subjects and ensure that you have followed privacy best practices.

You must first obtain an individual's lawful permission before collecting, using, storing, transmitting or transferring their data.
